1. Scope of Application

These Terms of Service apply to all contracts between Linki Tools (hereinafter "Provider") and the user (hereinafter "you") regarding the use of the PetoVita service.

2. Service Description

PetoVita is a personal story journal that:

  • Sends you regular questions about your life via email
  • Securely stores your answers
  • Uses artificial intelligence to create a cohesive narrative of your life story

The service is available in both a free and a premium version.

3. Content Ownership

PetoVita operates like a ghostwriter: We create content for you, not from you.

Your Ownership

  • Your Submissions: You retain complete ownership of all content you submit (answers, stories, memories).
  • AI-Generated Content: All AI-generated summaries, biographies, and narratives are created as deliverables for your benefit. You own these outputs and may use, share, publish, or modify them freely.
  • Future Products: When you purchase additional products like printed books or audiobooks of your biography, these also belong to you.

Our Limited Operational License

You grant PetoVita only the rights necessary to operate the service:

  • Storing your content in our database
  • Processing through AI systems to generate your summaries
  • Displaying within the platform
  • Sending via email to you
  • Creating backups for data security

What We Will Never Do

We will never use your content for:

  • Marketing or advertising
  • Training AI models
  • Licensing to third parties
  • Any commercial purpose beyond providing the service you requested

Any such use would require your explicit, separate opt-in consent.

Data Export

You can export your complete Q&A history and all generated content at any time.

4. Registration and Account

  • Registration requires a valid email address.
  • You must be at least 16 years old to use PetoVita.
  • You are responsible for keeping your login credentials secure.
  • One account per person.

5. Subscriptions and Pricing

Free Version

  • Weekly questions via email
  • Unlimited answer storage
  • AI summaries up to 1,500 tokens
  • Data export

Premium Version

  • All features of the free version
  • Extended AI summaries up to 4,000 tokens
  • Price: €5.99 per month or €59.99 per year
  • All prices include VAT

Payment

  • Payments are processed via Stripe.
  • Subscriptions renew automatically unless cancelled.
  • Monthly subscriptions can be cancelled at any time, effective at the end of the billing period.
  • Annual subscriptions can be cancelled at any time, effective at the end of the annual period.

6. User Obligations

When using PetoVita, you agree to:

  • Use the service only for personal, non-commercial purposes
  • Not submit any illegal, offensive, or harmful content
  • Not abuse the service or interfere with its operation
  • Not use automated systems to interact with the service

7. Availability and Warranty

  • We strive for high service availability but cannot guarantee it.
  • AI-generated content is based on your input and may contain inaccuracies.
  • We reserve the right to develop and improve the service.

8. Limitation of Liability

  • We are fully liable for intent and gross negligence.
  • For slight negligence, we are only liable for breach of essential contractual obligations, limited to foreseeable, typical damages.
  • Liability for data loss is limited to typical recovery costs.
  • These limitations do not apply to damages resulting from injury to life, body, or health.

9. Termination

  • You can delete your account at any time.
  • Premium subscriptions can be cancelled via the customer portal.
  • We may terminate the account for violations of these Terms.
  • Upon termination, your data will be deleted according to our Privacy Policy.

10. Changes to Terms

  • We may change these Terms with reasonable notice.
  • Changes will be communicated via email at least 4 weeks before taking effect.
  • If you do not object within this period, the new Terms are deemed accepted.
  • For significant changes, you may terminate the contract.

11. Final Provisions

  • German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
  • Place of jurisdiction for merchants is the Provider's registered office.
  • For consumers, the statutory place of jurisdiction applies.
  • The EU Commission provides a platform for online dispute resolution: ec.europa.eu/consumers/odr
  • We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
